Lumindra — Terms of Use

These Terms of Use ("Terms") govern your use of the Lumindra mobile app ("Lumindra", "we", "us"). By downloading or using Lumindra, you agree to these Terms. If you do not agree, please do not use the app.

Health & wellness disclaimer. Lumindra provides binaural-beat audio and soundscapes intended for relaxation, focus, sleep, and general wellbeing. It is not a medical device and does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional care. Consult a qualified healthcare provider about any medical condition. Do not use Lumindra while driving or operating machinery. If you have epilepsy or a seizure disorder, are pregnant, use a pacemaker or hearing device, or experience any discomfort, discontinue use and consult a medical professional.

Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use Lumindra for your own non-commercial use, subject to these Terms and the app store terms that apply to your download.

No account required

Lumindra does not require you to create an account or sign in. Your progress and preferences are stored on your device; uninstalling the app removes them. Your subscription is managed through your App Store or Google Play account.

Subscriptions & billing

Apple Standard EULA

If you download Lumindra from the Apple App Store, your use is also governed by Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with that agreement, the Apple agreement governs your Apple download.

Acceptable use

You agree not to reverse engineer, resell, or misuse the app, interfere with its operation, or use it in any unlawful way.

Intellectual property

Lumindra, including its audio, artwork, the "Wisp" character, and software, is owned by us and protected by intellectual-property laws. These Terms do not transfer any ownership to you.

Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the app and delete your account at any time.

Disclaimers

Lumindra is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or inability to use, the app.

Governing law

These Terms are governed by the laws of The State of Ohio, United States, without regard to conflict-of-law principles.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above.
